TN Visa

The TN nonimmigrant visa allows eligible Canadian and Mexican nationals to apply for temporary admission to the United States in order to engage in professional business activities. 

The agreement is accessible to citizens of these nations under the North American Free Trade Agreement (NAFTA) which established strong economic and trade connections between the United States, Canada, and Mexico. Accountants, engineers, lawyers, pharmacists, scientists, and teachers are among the professionals who may apply for admission as TN nonimmigrants.

The TN classification allows visa holders to work in the United States for a period of up to three years, which may be extended continuously.

Dependents of the TN visa can come to the United States under TD status. They may not work in the U.S but may attend schools.

Requirements

To qualify for a TN visa, the following requirements must be met:

  • The applicant must be a Canadian or Mexican citizen

  • The applicant is qualified in one of the NAFTA-accepted occupations

  • The position in the United States requires a NAFTA professional

  • The applicant has already secured a part-time or full-time position with a U.S. employer. This visa does not permit self-employment

  • Evidence that the applicant meets the position's qualifications and educational requirements

Educational requirements

A Baccalaureate or Licenciatura degree is required for the majority of occupations. A three-year degree may be considered a baccalaureate. It is not necessary to obtain a four-year degree. The applicants’ degree should be in the area of the TN profession for which they are applying or in a closely connected one. If they earned their degree, certificate, or diploma outside of the U.S, Canada, or Mexico, they must also submit a credentials evaluation demonstrating that that degree, certificate, or diploma is equivalent to a Mexican, Canadian, or U.S degree, certificate, or diploma.

Eligibility for Canadian citizens

Canadian citizens, unlike Mexican citizens, are typically eligible for nonimmigrant admission without a visa. So, Canadian citizens are not required to apply for a TN visa at a U.S consulate. A spouse and children of Canadian citizens are also eligible to come without a visa. They must submit necessary documents to a United States Customs and Border Protection (CBP) officer at select CBP-designated United States ports of entry or pre-clearance/pre-flight inspection stations. The following documentation must be presented to the Customs and Border Protection officer:

  • proof of Canadian citizenship; 

  • a letter from your potential employer outlining your professional role in the United States, the purpose of your employment, your duration of stay, and your educational qualifications; and

  • a credential evaluation together with any related costs.

Mexican citizens

If the applicant is a citizen of Mexico, he or she must get a visa in order to enter the United States as a TN nonimmigrant. He or she should apply directly to a US embassy or consulate in Mexico for a TN visa. Once granted a TN visa, applicants may petition for entrance at select CBP-designated US ports of entry or pre-clearance/pre-flight inspection stations. A spouse and children of Mexican citizens must apply at an American embassy or consulate for a TD nonimmigrant visa.

  • Economist - Baccalaureate or Licenciatura Degree

  • Engineer - Baccalaureate or Licenciatura Degree OR state or provincial license

  • Forester - Baccalaureate or Licenciatura Degree OR state or provincial license

  • Graphic Designer - Baccalaureate or Licenciatura Degree

  • Hotel Manager - Baccalaureate or Licenciatura Degree in hotel/restaurant management OR Post-Secondary Diploma or Post-Secondary Certificate in hotel/restaurant management and 3 years of experience in hotel/restaurant management

  • Industrial Designer - Baccalaureate or Licenciatura Degree OR Post-Secondary Diploma or Post-Secondary Certificate and 3 years of experience

  • Interior Designer - Baccalaureate or Licenciatura Degree OR Post-Secondary Diploma or Post-Secondary Certificate and 3 years of experience

  • Land Surveyor - Baccalaureate or Licenciatura Degree OR state, provincial, or federal license

  • Landscape Architect - Baccalaureate or Licenciatura Degree

  • Lawyer (Including Notary in the Province of Quebec) - LL.B., J.D., LL.L., B.C.L. or Licenciatura Degree (5 years) OR membership in a state or provincial bar

  • Librarian - M.L.S. or B.L.S. (for which another Baccalaureate or Licenciatura Degree was a prerequisite)

  • Management Consultant - Baccalaureate or Licenciatura Degree OR equivalent professional experience as established by statement or professional credential attesting to 5 years of experience as a management consultant OR 5 years of experience in a field of specialty related to the consulting agreement

  • Mathematician (Including Statistician) - Baccalaureate or Licenciatura Degree

  • Range Manager/Range Conservationist - Baccalaureate or Licenciatura Degree

  • Research Assistant - Baccalaureate or Licenciatura Degree

  • Scientific Technician/Technologist - 1. No degree required (but the TN worker must directly support a degreed professional); 2. Possession of theoretical knowledge of any of the following disciplines: agricultural sciences, astronomy, biology, chemistry, engineering, forestry, geology, geophysics, meteorology, or physics; AND 3. the ability to solve practical problems in any of those disciplines, or the ability to apply principles of any of those disciplines to basic or applied research

  • Social Worker - Baccalaureate or Licenciatura Degree

  • Sylviculturist (Including Forestry Specialist) - Baccalaureate or Licenciatura Degree

  • Technical Publications Writer - Baccalaureate or Licenciatura Degree OR Post-Secondary Diploma or Post-Secondary Certificate and 3 years of experience

  • Urban Planner (Including Geographer) - Baccalaureate or Licenciatura Degree

  • Vocational Counselor - Baccalaureate or Licenciatura Degree
