The employer is expected to advertise in at least three different places, including the Government of Canada's Job Bank, for a minimum of four weeks.

Application Submission: If no suitable Canadian candidate is found for the job, the employer can submit an application for an LMIA to ESDC/Service Canada. The application needs to include details about the position, evidence of recruitment efforts, and a fee payment.

Assessment: Service Canada reviews the application to determine the impact that hiring a foreign worker would have on Canada's job market. During this review, various aspects are considered, such as the wages and working conditions offered and the economic benefits that the hiring could bring to Canada.

Decision: If Service Canada finds that hiring a foreign worker will have a neutral or positive effect on the Canadian labour market, they issue a positive LMIA.

A positive LMIA can be used by the foreign worker to support their work permit application or permanent residence application through Express Entry.

Types of LMIAs

There are different types of LMIAs, each serving different purposes.

High-wage LMIAs apply to positions where the wage offered is at or above the provincial/territorial median hourly wage.

Low-wage LMIAs are for positions with wages below the provincial/territorial median hourly wage.

Agricultural stream LMIAs are designed for positions related to on-farm primary agriculture.

Permanent Residence LMIAs are intended to support a foreign worker's application for permanent residency.
